DAP’s Lim Guan Eng is appealing for higher damages after winning a defamation case, arguing that the RM50,000 award is inadequate to compensate for the damage to reputation.
kuala lumpur: DAP consultant Lim Guan Eng has filed an appeal against the amount of damages awarded in his successful defamation suit.
His lawyer, Datuk Shankar Nair, confirmed that the notice of appeal was filed at the Court of Appeal today.
The appeal is limited to challenging the amount of damages awarded by Judicial Commissioner Shoba Menon in the Shah Alam High Court.
“Our client is grateful and appreciative of the High Court’s decision accepting his defamation claim, holding the defendants liable and awarding damages,” Shankar Nair said in a statement.
“However, our client is dissatisfied with the quantum of damages awarded, namely RM50,000 in global damages and RM5,000 in costs, which he considers to be clearly inadequate in the circumstances.”
The appeal seeks re-evaluation to appropriately reflect the seriousness of the defamatory statements.
It argues that damages should be proportionate to the damage caused to Lim’s reputation.
Lim filed the defamation suit in the Shah Alam High Court on June 7, 2024.
The defendants were former Housing and Local Government Minister Datuk Zuraida Kamaruddin, MalaysiaNow editor Muhammad Abd Ar-Rahman Koya and AmNow Media Sdn Bhd.
The High Court had ruled that the statements made against Lim were defamatory.
