Openai is asking Meta to produce evidence related to any coordinated scheme with Elon Musk and XAI so that it can acquire or invest in chat-makers.
The request was made public in a brief filed on Thursday in the ongoing trial of Elon Musk against Openai. The lawyers representing Openai said that in June they had submitted to the Meta to acquire startups in February for documents related to their possible participation in the unwanted, $ 97 billion bid of Musk. It is not clear from the filing whether such documents exist. Openai eventually denied Musk’s bid.
Openai lawyers say they came to know that Musk interacted with Meta CEO Mark Zuckerberg to buy a chat-meker about XAI’s bid, including “about potential financing or investment”.
Meta objected to Openai’s early sub -soul in July; Chat-Maker lawyers are now demanding a court order to get such evidence. Openai is also asking the court for communication related to any of the meta documents and communication related to “any real or potential restructuring or repetition of openiI” – the main issue in Musk’s trial against OpenEE.
Meta spokesperson Andy Stone directed Techcrunch to a part of Openai’s filing, stating that neither meta nor Zuckerberg signed the intention of Musk’s letter to acquire a chat-maker.
Meta refused to comment further. Openai and the legal lawyer for Musk did not immediately respond to Techcrunch’s remarks request.
In the backdrop of the Battle of Openai with Musk, Meta has invested significantly in its efforts to develop Frontier AI models. In 2023, Meta officials focused on developing an AI model, which could defeat Openi’s GPT -4, showing a court filing in another case. In early 2025, the Meta’s AI model fell behind the industry’s standard, allegedly influenced Zuckerberg.

Zuckerberg has increased the pressure in recent months, stoleing several prominent AI researchers in OpenaiI, including a co-producer of chatgip, Shengzia Jhao, who now leads the company’s newest AI Unit, Meta Superintendent Labs. Meta also invested $ 14 billion at Scale AI, and allegedly approached several other AI laboratories about acquisition deals.
Although it is not clear how far the conversation between Musk and Zuckerberg took place, the only idea of a partnership between the two billionaires shows how much of openi is at risk. Two years ago, Musk said he would physically fight Zuckerberg in a Cage match (although it never happened).
AI’s Uday may have inspired Kasturi and Zuckerberg to separate their differences.
On Thursday, the revealed briefing is part of a large case filed by Musk against Openi that raises the issue with conversion of the open-profit arm of the openiAI to the corporation. Such a conversion is necessary for Openai to get funds from investors, and eventually become public. However, Musk – a cofounder and initial investor in Openi – attempted to throw a wrench in the attempt, claiming that the reorganization goes against the mission of the startup.
The lawyers representing the meta asked the court to reject OpenaiI’s request for evidence, arguing that Musk and XE could provide any relevant information. Meta also argues that the internal discussion of reorganization and reconstruction of Openai is not relevant to the matter.
This story has been updated to add more information about the case, as well as the history of Musk and Zuckerberg’s relationship.
