Healthcare providers used the information of the employee to file fraud and suspected medical claims for the services that were never provided or not medicalally necessary, the OIG said. Of the 119 implicated employees, 28 retired or resigned as a result of OIG investigation, and 30 left the company for “other reasons”. Another dozen employees have been criminally accused, and seven are convicted and are waiting for the sentence.

OIG initiated an investigation when an agent saw the unusual billing pattern in the report by data analysts. Three New York Healthcare providers with “suspected” billing shared a high number of entraks employees as patients were identified by investigators.

Figuero then presented alleged fake claims on Emitrak’s healthcare plan, stating that the agent visited the providers at least seven times in May 2021 for acupuncture and physical therapy in May 2021. The agent again visited the Figuro’s office on July 29, 2021, where he allegedly handed him an envelope of $ 1,000.
Investigators said that Figueroa continued to use the agent’s insurance information to present dozens of fraud claims for the Emitrak’s healthcare plan.
Figuroe convicted the Emitory’s healthcare plan for cheating, sentenced under three years of supervision and ordered to pay a restoration of $ 9.05 million. Two other healthcare providers and a medical biller have also convicted their roles in the scheme.

Michael Denicola, a podiatist from New York, convicted on 29 June 2022, health care fraud, distribution of a controlled substance and plotting illegal possession of a gun. He has not been punished yet.
Regina Choi, Woodside, a Medical Biller from New York, who had previously worked for Figueroa, blamed on June 11, 2024 for conspiring to conspiracy on 11 June 2024 for presenting claims of false and fraud and giving cash kickback to EMTRC employees. His punishment is also pending.
In 2018 and 2019, the OIG auditors released separate reports, stating that Emitrak may soon strengthen measures to identify fraudulent medical claims. OIG said that both reports indicate possible fraud between hundreds of providers.
